TERMS OF SERVICE

These Terms of Service govern your use of the WMF XIII online store and related services operated by WMF XIII Inc.
By using our services or placing an order, you agree to these Terms and the policies incorporated into them. If you do not agree, do not use the services.
ELIGIBILITY AND CUSTOMER ACCOUNTS
You must have the legal capacity to enter into the relevant transaction and meet any product-specific minimum age.
You are responsible for providing accurate information, protecting your account credentials and monitoring activity conducted through your account.
Contact concierge@wmfxiii.com promptly if you suspect unauthorised access.
OUR RETAIL MODEL
WMF XIII is a curated luxury digital department store presenting products from independent queer brands, creators, makers, artisans, chefs, designers and artists, together with WMF XIII private-label products.
Products may be fulfilled by WMF XIII or an approved partner. WMF XIII remains the customer’s primary point of contact for order service, returns and refunds.
PRODUCT INFORMATION
We work to present accurate product descriptions, provenance, images, colours, dimensions, ingredients, materials, availability and pricing.
Screen displays, natural materials, handmade production and small-batch manufacturing may produce reasonable variations.
If material information is incorrect or a product becomes unavailable, we may contact you for instructions or cancel and refund the affected item. We will not substitute a materially different product without your consent.
ORDERS AND ACCEPTANCE
Submitting an order through checkout constitutes an offer to purchase.
An automated order acknowledgement confirms that we received your order. It does not necessarily constitute final acceptance.
We may decline or cancel an order for reasons including:
• Inventory or pricing errors.
• Suspected fraud or unauthorised payment.
• Payment failure.
• Legal or delivery restrictions.
• Inability to fulfil the order.
• Breach of a disclosed purchase limit.
• Another legitimate operational or legal reason.
If payment has been captured for an item we cancel, we will issue the appropriate refund.
PRICES AND PAYMENT
Prices are displayed in the currency shown on the website. Applicable taxes, shipping charges and other mandatory charges will be disclosed before you submit your order.
You authorise the selected payment provider to charge the total displayed at checkout.
We may correct an obvious pricing or description error, but we will not charge a higher corrected price without your agreement.
PRE-ORDERS, MADE-TO-ORDER AND PERSONALISED PRODUCTS
Pre-orders, personalised goods, bespoke products and made-to-order products may have special production estimates, deposits, cancellation restrictions and return conditions.
Material restrictions will be disclosed on the product page or during checkout before purchase. Your statutory rights remain unaffected.
SHIPPING, RETURNS AND PRIVACY

ACCEPTABLE USE
You may not:
• Use the services unlawfully or fraudulently.
• Interfere with website security or operation.
• Attempt unauthorised access to an account, system or data.
• Introduce malicious code.
• Impersonate another person.
• Submit false or misleading information.
• Infringe another person’s intellectual-property, privacy or other rights.
• Scrape, harvest or reproduce website content at scale without permission.
• Use the services in a manner that harms WMF XIII, its customers, partners or community.
INTELLECTUAL PROPERTY
The WMF XIII storefront, brand elements, editorial content, photography, graphics, designs and software are owned by or licensed to WMF XIII Inc. and are protected by applicable law.
Purchasing a product does not transfer intellectual-property rights in the product design, artwork, brand or related content.
USER-SUBMITTED CONTENT
If you submit a review, photograph or other content, you confirm that you have the right to submit it.
You grant WMF XIII Inc. a non-exclusive, worldwide, royalty-free licence to host, reproduce and display that content in connection with store operation and promotion, subject to applicable privacy choices.
We may remove content that is unlawful, misleading, abusive, discriminatory, defamatory, infringing or unrelated to the relevant product or service.
THIRD-PARTY SERVICES AND LINKS
Our services may rely on or link to third-party providers. Separate terms may apply to services those parties independently control.
WMF XIII is not responsible for unrelated external websites merely because a link is provided. We remain responsible for obligations that applicable law places on us as the seller or organisation controlling personal information.
DISCLAIMERS AND LIABILITY
Our services are provided on an “as available” basis, subject to warranties, guarantees and consumer rights that cannot lawfully be excluded.
To the maximum extent permitted by law, WMF XIII Inc. is not liable for indirect, incidental or consequential loss arising from the use of the services.
Nothing in these Terms excludes or limits liability, consumer rights or remedies that cannot lawfully be excluded or limited.
INDEMNITY
To the extent permitted by law, you are responsible for losses directly resulting from your unlawful misuse of the services or infringement of another person’s rights.
This provision does not make a consumer responsible for the actions or legal obligations of WMF XIII Inc.
CHANGES, SUSPENSION AND TERMINATION
We may update or discontinue features and may suspend access where reasonably necessary for security, fraud prevention, legal compliance or a material breach of these Terms.
Changes to these Terms apply prospectively from the posted effective date unless applicable law requires otherwise.
Terms governing an accepted order will not be changed retroactively to reduce the customer’s rights.
SEVERABILITY
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
NO WAIVER
A delay or failure to enforce a provision does not waive the right to enforce it later.
GOVERNING LAW AND DISPUTES
These Terms are governed by the laws of Ontario and the federal laws of Canada applicable in Ontario.
This choice of law does not deprive a consumer of mandatory protections that apply in the consumer’s home jurisdiction.
Before beginning formal proceedings, contact hello@wmfxiii.com so we can attempt to resolve the matter fairly.
Courts with lawful jurisdiction may hear unresolved disputes. Nothing in these Terms requires a consumer to waive a forum, remedy or protection that cannot lawfully be waived.
